New Albany shares a common thread with the southwestern Indiana city of Vincennes in that George Rogers Clark made a significant impact on the territory. After capturing the area in 1779, Clark was awarded large tracts of land for his service and later distributed areas of the rolling countryside to his soldiers. Eventually three New Yorkers arrived in the area, purchasing land from one of Clark’s soldiers, Col. John Paul, and naming the city after Albany in their home state. New Albany actually claimed the title of Indiana’s largest city until 1860. New Albany continued to grow through the 20th Century with the construction of Interstate 64 and the Sherman Minton Bridge. Like Evansville, New Albany is a beautiful river city, perched on the banks of the Ohio and has made great strides in recent years to incorporate the riverfront into the city. As of 2019, Floyd County had a population of a little more than 77,000 people. Major employers in the area include Baptist Health, Nyx New Albany, Indiana University Southeast, Samtec Inc, Hitachi Cable America Inc, and Baptist Health Medical Group, among others. According to the Indiana University Public Policy Institute for the most recent yearly report at the time of writing there were 2800 vehicle collisions in Floyd County resulting in 6 fatalities. Statistically, New Albany had the most car crashes with 1860, followed by Georgetown with a sparse 62. Two of the fatal collisions occurred on I-265 and one on I-64. Many of these crashes will lead to lawsuits, as insurance companies may not be willing to fairly compensate the injured or families of those killed in car or truck crashes. As the county seat, injury and wrongful death cases arising in Floyd County are often filed in Floyd County Circuit or Superior Court. In addition, New Albany is home to the eastern-most division of the United States District Court for the southern district of Indiana. The attorneys at Barsumian Armiger Injury Lawyers practice in both federal and state courts and are well-equipped for the challenges of high-stakes litigation and trials in either venue. They provide free consultations to New Albany residents whether injured in Floyd County or on their morning or evening commute to or from Louisville.
A quick review of Indiana’s mandatory medical error reporting data for the most recent yearly summary showed only one reported error by Floyd County medical providers, which was a retained foreign object. No medical errors were reported for other mandatory reporting categories such as surgery performed on the wrong body part, surgery performed on the wrong patient, wrong surgical procedure performed on a patient or intra-operative or post-operative death in a normal, healthy patient. Similarly, no events were reported for death or serious disability caused by contaminated drugs, devices, or biologics, misuse or malfunction of a device, or intravascular air embolism. Finally, no death or serious disability was reported for medication error, hemolytic reaction, low risk pregnancy or delivery, hypoglycemia, hyperbilirubinemia in neonates, stage 3 or 4 pressure ulcers after admission, or during joint movement therapy. Once this change was made the case became a...
