Todd Barsumian is registered as a mediator by the State of Indiana. He uses his experience on both sides of legal disputes when helping parties to resolve them. Todd has handled a variety of litigation representing both business and individuals. Todd embraces the process of court-ordered dispute resolution and provides a written mediation agreement to the parties before every mediation so everyone understands the ground rules. Todd and his firm also have the necessary technology to host remote mediation sessions. Todd has handled a number of mediations via Zoom.

Todd estimates that 75% of the cases he has handled involve allegations of personal injuries or wrongful death, so he has extensive experience evaluating the value of the damages that are often paid in settlements or in verdicts rendered by juries. Injuries Todd has experience litigating and valuing include adult wrongful death, general wrongful death, child wrongful death, cervical, thoracic, and lumbar injuries such as disc bulges and herniations, catastrophic brain injuries, concussions, open reduction and internal fixation (ORIF) injuries, degloving injuries, amputations, loss of vision, organ loss, burns, tissue loss, scarring, infections, airbag injuries, crush injuries, fractures, closed reduction injuries, and a variety of others.

Todd has handled numerous industrial and consumer warranty and product liability cases for both plaintiffs and defendants. He has sought enforcement of and defended against the enforcement of non-compete agreements. He has also litigated a number of unfair competition and trademark infringement cases in federal and state court. Todd has defended and pursued discrimination, retaliation and other wrongful termination cases. He has also served as a panel chair for medical review panels in Indiana before the Indiana Department of Insurance proceedings required under Indiana’s Medical Malpractice Act. For many years in the first half of his career, Todd was hired by automobile insurance companies to defend claims brought against their insureds, so he evaluated claims for insurers and routinely worked with insurance claims handlers and adjusters. He appreciates the interests of both sides to the dispute and feels he can often help bridge the gap during stalled negotiations by helping both sides understand and appreciate risks that may have been overlooked.

Unlike some mediators, Todd brings to mediations his experience as an attorney who has significant local jury trial experience before multiple judges. Todd has tried a number of jury trials to verdict, including trials in the southwestern Indiana counties of Vanderburgh, Warrick, and Gibson, southeastern county of Floyd, and Henderson County, Kentucky.

Innovative, Personalized And Experienced Indiana Mediator

Although Todd believes in the necessity of trial by jury under certain circumstances, he also believes most cases can be resolved prior to trial when the parties take the opportunity to realistically consider and reflect on the risks and costs attendant to any trial. Mediation presents the parties with the opportunity to listen to each other in a private, controlled setting without interruptions. Todd is familiar with a variety of mediation tools and techniques whether they be from the Getting to Yes theory of negotiation popularized by Miller and Ury, techniques he has learned through his training in seminars, or ideas he has gleaned from the hundreds of mediations he has participated in over the years. More importantly, Todd understand and appreciates the interests of both sides to conflict and takes the challenge of resolving differences and giving peace to all involved very seriously. That being said, he also understands the need to get to know the parties and their individual concerns and desires, so that he may help craft an acceptable resolution for all involved.
